Significant False Claims Act Case Law Developments and Preparing for FCA Enforcement in the Post COV

The FCA is the federal government’s primary weapon to combat allegations of fraud and abuse in its programs. This presentation will address significant new trends that have emerged regarding FCA enforcement, such as how circuit courts have split regarding whether reasonable clinical judgment can form the basis of an FCA action, whether claims can be materially false if the government does not routinely seek repayment through administrative action, and when violations of the Anti-Kickback law and Stark law can constitute a violation of the FCA.
The webinar will also discuss the likely enforcement actions the government or qui tam relators will undertake stemming from government funding related to COVID-19 and steps health care entities can take to reduce exposure to liability.
