HHS in the First 100 Days: A Look at How Policy Priorities Have (and Haven’t) Shifted from Trump to Biden (On-Demand Webinar)

Time: On Demand

Difficulty: Advanced

Overview: Panelists Kelly Cleary and Brenna Jenny each served (consecutively) as the CMS Chief Legal Officer during the Trump Administration. In this webinar, they will share the ways in which the Biden administration has continued Trump Administration policies, and the ways in which the Biden Administration has changed direction and begun to implement new policies. Early on, the Trump Administration embarked on a regulatory and enforcement reform agenda that included efforts to clamp down on “rulemaking by guidance” and promote the rule of law through fairness and transparency in civil enforcement. Under President Trump, HHS also identified 4 key policy priorities to guide the Department's work (the opioid crisis, health insurance reform, drug pricing, and value-based care). Panelists will cover each of these areas in this webinar through the following topics:

  • Actions to curb issuance of sub-regulatory guidance
  • The Supreme Court’s Decision in Allina and HHS’ implementation of the decision (the “Cleary-Jenny Memo”)
  • Drug pricing reforms like the Rebate Rule, Most Favored Nations Model
  • New protections for value-based arrangements under the AKS Safe Harbors and Stark Law
  • ACA Section 1332 Waivers
  • Medicaid 1115 Demonstrations
