Overview: Antitrust enforcers at DOJ and FTC have signaled that private equity (PE) firms’ transactions in health care are likely to receive much greater antitrust scrutiny going forward.  According to enforcers, the proliferation of PE deals in the U.S. has caused a range of harms, including reduced health care quality and access, as well as increasing health care costs.  Parties to health care deals involving PE firms should consider this new enforcement landscape when planning deals.
