Overview: OIG’s November 2023 General Compliance Program Guidance and several court cases have emphasized the importance of reasonable and fair market value compensation for health care transactions and arrangements of nearly all types. But it has become a recurring theme in government guidance and enforcement actions that sometimes it is not enough to merely have a report or opinion of fair market value, but rather, parties must have a determination that matches evolving facts and circumstances and is appropriate for the evolving state of the applicable law. This webinar dissects recent case law for what counsel, compliance officers, and consultants need to know going into 2025.

Learning Objectives: 

  • Gain insight into significant 2024 case law and federal and state regulatory enforcement changes that may affect what courts and government agencies will look for (and how they will look for it) when evaluating defensibility of fair market value determinations in the future. Issues include accuracy, methodology, and attorney-client privilege/discoverability over communications of drafts and data.
  • Receive tips and tools to understand the current typical and necessary elements of fair market value analyses and other types of valuation reports, and how and why they may have changed.
  • Learn how to issue spot and address common pitfalls in managing the fair market value review process, with tips for mitigating risks, managing costs, and avoiding stumbles and pitfalls that may delay or derail a process.
