Overview: This webinar is part of a two-part series on agency reviews of hospital mergers and is aimed at attorneys whose practices are not antitrust-focused. The webinar discusses the considerations involved in antitrust merger review in health care transactions; specifically, the importance of preparing for and managing hospital merger transactions that are likely to receive scrutiny from regulatory agencies. The session also covers the impact of information requests (e.g., Second Requests) from the government, and the roles of both in-house and outside counsel in navigating these issues. The speakers delve into the negotiation and management of the government’s requests, the scope and types of information requested, costs involved, and outside counsel’s role in responding to the government and share insights into general challenges facing clients during investigations, new types of information requested by the FTC and state AGs, and preparing documentation for future inquiries.
