Overview: This webinar covers the benefits/costs of arbitration, choosing arbitrators and arbitration service providers, and best practices for drafting arbitration agreements in the employment context. Speakers also examine developing issues of law regarding arbitration, including the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, class action waivers, and mass arbitration. Disputes with both non-exempt staff and physicians are also discussed.
Learning Objectives:
- Understand key considerations in deciding whether to implement an arbitration program.
- Learn how the Ending Forced Arbitration Act (EFAA) is impacting enforcement of arbitration agreements, and the current state of the law regarding the EFAA.
- Understand strategies for using arbitration agreements to reduce the risk of class actions, and the emerging risk of mass arbitration.
