Overview: In-house counsel are often the gatekeepers for preventing, discouraging, investigating, and disclosing corporate misconduct. This webinar utilizes a fact pattern scenario involving alleged violations of the Stark law and False Claims Act to examine an attorney’s role in preventing, discouraging, investigating, and disclosing corporate misconduct and the potential attorney ethics rules that are implicated in this role, including ABA Model Rule 1.13 – Organization as Client; ABA Model Rule 1.16 – A Lawyer’s Due Diligence; and ABA Model Rule 1.6 – Confidentiality.
Learning Objectives:
- Learn about the role of in-house counsel in governmental investigations including the identification of the client and confidentiality requirement by counsel.
- Explore fact patterns from recent Stark and False Claims Act cases to examine the requirements of counsel to perform due diligence and to "go up the ladder" when a client potentially ignores legal advice.
- Examine the importance of in-house counsel staying current on the law.
