Overview: The No Surprises Act (NSA) is the most consequential U.S. consumer protection bill in decades. The NSA fulfilled its promise in taking consumers out of the middle of out-of-network payment disputes between payers and providers. However, three years after it became effective, payers and providers continue to spar over the NSA, its implementing regulations, and through the Act’s independent dispute resolution (IDR) process. Moreover, the courts have become a new arena for IDR disputes. This webinar presents updated statistics, outcomes, and observations from the NSA’s IDR process and looks at provider lawsuits to enforce and vacate IDR awards, strategies for managing lawsuits, and the upcoming consequential ruling from the Fifth Circuit that may dictate whether enforcement lawsuits are appropriate. Speakers also discuss legislative and regulatory updates and guidance, including the Fifth Circuit’s ruling on agency rules concerning how payers calculate the qualifying payment amount.
