Overview: This webinar explores CMS’ significant expansion of the prohibition against third-party guarantees for skilled nursing care. The change, effective April 28, 2025, severely limits providers’ ability to obtain relief against bad-acting third parties who fail to use the resident’s income and resources to pay for their care, or who fail to cooperate in the Medicaid eligibility process. Presenters educate providers on contractual language that should be avoided in admission agreements to steer clear of a violation and explore the adverse impact on the provider’s ability to secure payment and offer alternative legal avenues for recourse and best practices to avoid bad debt.
Learning Objectives:
- Learn how CMS has expanded the prohibition against holding third parties liable for payment for a SNF resident’s care.
- Detail how SNFs will need to modify Admission Agreements to remain compliant.
- Analyze the impact on the ability of SNFs to pursue recovery against bad/non-acting third parties.
