Overview: This two-part webinar explores the Patient Safety and Quality Improvement Act of 2005 (PSA). Part 2 will summarize key trial and appellate court decisions that have interpreted the scope of privilege protections afforded under the PSA. Speakers also discuss litigation lessons learned, how to anticipate the types of plaintiff and court positions that may lead to rejecting the privilege, and best practices in defending against discovery demands.

Learning Objectives: 

  • Understand how the courts are reviewing and interpreting the scope of privilege protections under the PSA.
  • Learn about the types of arguments asserted by plaintiff attorneys in demanding access to privileged information, and how to defend against these subpoena and other demands.
  • Identify best litigation practices to achieve successful outcomes in these discovery disputes.
