Overview: The No Surprises Act was enacted in 2022 to protect patients from surprise medical bills, while still ensuring fair reimbursement to providers. Since its inception, the law has been the subject of intense debate and has seen multiple waves of legal challenges. The Act established an independent dispute resolution (IDR) process to resolve payment disputes over out-of-network emergency services. In recent years, extensive rulemaking has refined the parameters of the IDR process and there has been incredible growth in the volume of IDRs. Yet the IDR process, and enforcement of IDR awards, remains a source of ongoing frustration for both payers and providers. This webinar examines the issues surrounding IDR from three perspectives--from counsel representing health insurers and providers and a self-funded Taft-Hartley health & welfare trust.

Learning Objectives: 

  • Describe the overall IDR process as it is used by providers and payers and examine anticipated impacts of the new June 2026 IDR Operations Final Rule
  • Discuss the status of nationwide litigation, including efforts by both providers and payers
  • Look at current lobbying and legislative efforts by both providers and payers to amend the NSA to  fix perceived deficiencies
